Seed Giants Prevail in Lawsuit Alleging Farmer Price-Fixing
A recent ruling dismissed a 2021 lawsuit accusing Bayer, Corteva, and Syngenta of price-fixing in the agricultural chemical industry. The lawsuit alleged that the companies conspired to keep prices high by avoiding e-commerce platforms like Farmers Business Network. However, the judge found that there was no direct evidence of collusion or antitrust violations.
The growth of agricultural e-commerce platforms has allowed farmers to easily purchase crop inputs and compare prices. Farmers claimed that by keeping their products off these platforms, chemical companies were engaging in anti-competitive behavior to maintain higher prices.
The lawsuit alleged that the companies worked together to prevent their products from being sold on e-commerce platforms, resulting in a lack of transparency and competitive pricing. However, the judge ruled that the companies’ actions were within the scope of legitimate business strategies.
The lawsuit, which combined multiple claims against the companies, was dismissed without prejudice. This means that the plaintiffs have the option to refile the case in the future.
